Amendment #5



Full text Amendments

This amendment ensures that no person can be tried for a federal crime (capital offense) unless he or she has been charged by a grand jury. No person shall be prosecuted a second time for the same offense and by the same government. It can only be tried a second time if the jury can not agree to issue the verdict, if it is considered that the process was flawed for some reason or if a new trial is requested.


I chose this caricature because it represents how the fifth amendment can be used for defense in this case to the justice system itself. Without a fair trial no cause can be found for any individual.



This article is about the defendant Dassey who has been held in prison since he was 16 years old. Apparently his case has had many irregularities. In which it indicates that according to the fifth and the fourteenth amendment this one will be released soon.
